Case summary

On August 10, 2012, EPA issued a Stop Sale, Use or Removal Order (“SSURO”) to NewTechBio, Inc., of Howell, NJ. The SSURO barred the sale and distribution of the following pesticides: “NT – Shredder,” “Bed Bug Mace,” “Jet Black Pond, Lake and Lagoon Dye,” “True Blue Pond, Lake and Lagoon Dye,” “MAKO High Concentrate Lake Dye,” “NT-MAX Koi and Garden Pond Clarifier & Digester,” and “NT-MAX Biological Lake & Pond Digester” (Group 1 Pesticides), and “GreenClean Granular Algaecide,” “Rodeo,” “RootX,” “WhiteCap SC,” “Reward Landscape and Aquatic Herbicide,” “WEEDTRINE-D Aquatic Herbicide,” “Heritage DF Fungicide” and “Aquathol Super K” (Group 2 Pesticides). EPA determined that NewTechBio had made pesticidal claims about each Group 1 product, and had reason to believe that these products were not subject to an exemption from FIFRA’s registration requirements [unregistered pesticides, violation of FIFRA Section 12(a)(1)(A)]. However, EPA’s records showed that none of these products was or ever has been registered with EPA. EPA has determined that each Group 2 Pesticide was misbranded, because the labeling associated with each product in this group includes false or misleading statements [misbranded pesticides, violation of FIFRA Section 12(a)(1)(B)].
