Case summary

On September 25, 2012 EPA and the United States Department of the Army entered into a Federal Facilities Compliance Agreement (FFCA) for the Edgewater Area Wastewater Treatment Plant at Aberdeen Proving Ground in Maryland. The FFCA addresses Clean Water Act National Pollutant Discharge Elimination System (NPDES) permit violations by the Edgewater Area Wastewater Treatment Plant at the U. S. Army Garrison, Aberdeen Proving Ground, MD (APG). The Army was issued NPDES Permit No. MD0021229 on June 1, 2009. The Army has failed to meet its NPDES permit requirements to upgrade the wastewater treatment facility to achieve enhanced nutrient removal (ENR) and to meet its permit limits for nitrogen and phosphorous by July 1, 2012. The FFCA includes a compliance schedule for APG to upgrade the facility to achieve the nutrient removal requirements of the permit by September 15, 2015. In addition, the FFCA includes interim performance standards for biochemical oxygen demand, total suspended solids, ammonia nitrogen and total phosphorous during construction periods that affect plant processes, and progress reporting requirements.
