EPA v. ALCAVIS HDC LLC
Final Order No Penalty
Case summary
On September 30, 2010, EPA issued a SSURO to Alcavis barring the sale, use and removal of a Bleach-Wipe 1:100 dilution product, which EPA determined to be an unregistered pesticide. On February 23, 2011, Alcavis submitted proposed controls on the labeling, advertising, marketing, selling and distributing of its Bleach-Wipe 1:100 dilution product. On March 21, 2011, EPA issued a First Amendment to the Stop Sale, Use or Removal Order (Amended SSURO) based on a determination that Alcavis Bleach-Wipe 1:100 product will no longer be a pesticide requiring registration under FIFRA if the controls proposed in the February 23, 2011 letter are implemented that. The Amended SSURO permitd Alcavis to resume lawful sale and distribution of its Bleach-Wipe 1:100 dilution product consistent with the February 23, 2011 proposed controls.
