Case summary

RESPONDENT FAILED TO CONDUCT THREE YEAR REINSPECTION AND FAILED TO PROVIDE ANNUAL NOTIFICATION TO PARENT, TEACHER AND EMPLOYEE ORGANIZATIONS. On May 18, 2011, a Consent Agreement and Final Order (CAFO) was filed resolving violations of the Asbestos Hazards Emergency Response Act (AHERA) under the Toxic Substances Control Act (TSCA). The Canon-McMillan School District (CMSD) is located in Canonsburg, Pennsylvania. CMSD is the Local Education Authority responsible for AHERA compliance at the schools, failed to re-inspect schools every three years and failed to notify in writing parent, teacher, and employee organizations of the availability of an asbestos management plan. Management plans are used to note the location and condition of asbestos-containing materials (ACM) through-out the schools. A management plan helps prevent exposure to asbestos by ensuring that any maintenance or other routine school activities will not result in the disturbance of ACM. Annual notification on the availability of the management plan, allows parents, teachers, and employee organizations the opportunity for reviewing all information regarding ACM in the school. CMSD has approximately 4792 students and 850 employees.
