EPA v. AL SOLUTIONS, INC

Case summary

On April 11, 2011, EPA Region III issued an Administrative Order to AL Solutions, Inc., the operator and owner, of a titanium and zirconium processing facility located at 1000 S. Chester Street, West Cumberland, West Virginia (the “Facility”). On December 9, 2010, AL Solutions employees were handling titanium and an explosion occurred. Three people were killed and one was injured from the blast. As a result, EPA conducted an inspection of the Facility and noted unsafe design and unsafe practices at the facility. AL Solutions processes titanium and zirconium scrap into a fine powder for use as an additive to strengthen aluminum. Titanium and zirconium are extremely flammable, reactive, and ignitible (particularly when not fully submerged in water). EPA’s Order, issued pursuant to Section 113(a)(3)(B) of the CAA, requires the Facility to comply with the General Duty Clause requirements of Section 112(r)(1) of the CAA by complying with various standards applicable to the titanium and zirconium handling.
