The CAFO assesses a penalty for its violations of the PCB regulations. Specifically, Respondent stored combustible materials within 5 meters of PCB Transformers at 2 locations within the plant in violation of 40 C.F.R. § 761.30(a)(1)(viii). In addition, Respondent’s annual document logs for 2005-2008 contained inaccurate statements regarding the quantities of PCBs in use and were not prepared on a calendar year basis as required by 40 C.F.R. 761.180(a). At the time of EPA’s inspection of the cement plant, Respondent was using 3 PCB transformers containing 6,098 kilograms of PCB dielectric fluid.
