Case summary

On March 23, 2022, Region 3, in consultation with PADEP, issued a demand to Capital Region Water (CRW) for $15,500 in stipulated penalties for violations of requirements of CWA partial consent decree, including prohibitions on sanitary sewer overflows (SSOs) and dry weather overflows (DWOs) from CRW's combined sewer system. CRW has violated each of these CD provisions on numerous dates, including 31 DWOs, and 21 SSOs. EPA and PADEP have determined that they will pursue $13,000 in penalties for 25 of the 31 DWOs, and $2,500 for five of the 21 SSOs, for a total of $15,500 (divided equally between). The CRW service area includes EJ communities of concern.
