On _September 28, 2010, EPA issued a Notice of Determination (“NOD”) pursuant to the Small Business Compliance Policy,” 65 FR 19630 (April 11, 2000) (the “Small Business Policy”) to BioSpectra, Inc. (“BioSpectra”) for violations of Section 313 of the Emergency Planning and Community Right-to-Know Act (“EPCRA”), 42 U.S.C. § 11023, and its implementing regulations at 40 C.F.R. Part 372. The BioSpectra Facility is located at 2RR Box 2129G, Rockdale Lane, Stroudsburg, PA 18360. In a letter to EPA dated June 4, 2010, BioSpectra disclosed that the Facility had failed to submit Toxic Chemical Release Inventory Forms A for Hydrochloric Acid (aerosol) for the reporting years 2006 through 2008, as required by Section 313 of EPCRA.
