Case summary
On September 8, 2010, EPA Region III issued a Notice of Determination/Notice of Non Compliance to Trident Enterprises International, Inc. for violations of FIFRA. Trident disclosed the violations to EPA in a letter dated March 16, 2009 pursuant to the Self-Disclosure Policy. Trident sold and distributed a misbranded pesticide that did not have an EPA approved label affixed to the pesticide container, as required by Section 12(a)(1)(E) of FIFRA. Since it did not discover the violations through an audit or a Compliance Management System, Trident did not meet Condition 1, Systematic Discovery, and therefore, did not qualify for full penalty mitigation under the Self-Disclosure Policy. EPA considered the nature of the violations and the companys intent to fix the violations, and at this time, instead of assessing a civil penalty, EPA is issuing this Notice of Determination/Notice of Noncompliance to Trident for the disclosed violations.
