EPA v. FIGG BRIDGE EVELOPERS, LLC, ET. AL.

Final Order No Penalty

Case summary

On September 2, 2010, EPA issued a UAO to Figg Bridge Developers, LLC and SNJB Property, LLC requiring FIGG and SNJB to implement portions of the ROD, including designing and constructing a soil cover and stormwater management controls, implementing a traffic management plan, an institutional control plan, an O&M plan, and addressing sediment contamination inside the hollow concrete bridge support pipe piles, on a property that SNJB intends to purchase. In October 2009, EPA and FIGG entered into an agreement whereby FIGG agreed to pay EPA $110,536 and comply with a UAO requiring actions which contribute to the selected remedy in exchange for EPA releasing a lien on the property. FIGG and SNJB are constructing a new bridge to replace the Jordan Bridge which closed in 2008 on this property, which is within the Atlantic Wood Industries, Inc. Superfund Site. The Site is a former wood-treating facility located along industrialized waterfront adjacent to the Southern Branch of the Elizabeth River in Portsmouth, Virginia. The Site includes approximately 48 acres of land with contaminated soil and approximately 30 to 35 acres of contaminated river sediment.
