Case summary
On September 28, 2010, EPA signed a Super Consent Agreement and accompanying Final Order (SuperCAFO) with Evolving Solutions, Inc. of Middlebury, Indiana, for violation of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) requirements. Evolving Solutions Inc. failed to submit their Annual Pesticide Production report by the March 1st, 2010 deadline for their pesticide-production facility located in Pottstown, Pennsylvania. Evolving Solutions, Inc. did not have any active pesticide production at the facility during 2009, and has no plans on continuing to do so in the future. As a result, the company has opted to have the EPA establishment number (#83825-PA-001) terminated as part of their settlement agreement. All issues addressed in the SuperCAFO have been resolved
