Case summary
Respondents own and operate a ship, tug and barge repair facility in Baltimore, Maryland. OECEJ conducted an inspection and discovered violations of the CWA and RCRA. The Complaint is requesting the assessment of penalties for a failure to have a Spill Prevention Control and Counter Measure Plan, failure to develop and implement an appropriate Storm Water Pollution Prevention Plan and failure to make hazardous waste determinations. In addition, the Complaint is also requesting the Respondents immediately begin performing hazardous waste determinations on the solid wastes generated at the facility. The facility is adjacent to the northwest branch of the Patapsco River which flows into the Chesapeake Bay. Given its location and the presence of hazardous substances and oil, this action seeking penalties and compliance to address violations will reduce the risk of exposing the Chesapeake Bay to the hazardous substances and oil located at the facility.
