On September 3, 2008, EPA entered into a Consent Agreement/Final Order with Leed Foundry, Inc. (“Leed Foundry”), resolving EPCRA 313 TRI reporting violations. Leed Foundry, located at Wade Road, Saint Clair, Pennsylvania, is a iron and steel construction castings and gratings facility. Pursuant to the “Small Business Compliance Policy,” Leed Foundry disclosed that it failed to file TRI Form Rs for lead compound releases at its facility during the years 2003 through 2005. Since the facility was subject to two or more environmental enforcement actions in the past 5 years, Leed Foundry failed to satisfy criterion 4 of the “Small Business Compliance Policy.” Leed Foundry submitted the required Form R for calendar years 2003 through 2005. In consideration of Leed Foundry’s current financial condition, Leed Foundry is not required to pay a penalty for the disclosed violations.
