Case summary

Respondent failed to comply with PCB regulatory requirements and provisions in each of the following respects: 1. storing combustible materials within 5 meters of three PCB Transformers in violation of 40 C.F.R. § 761.30(a)(1)(viii); 2. failing to perform daily inspections to verify containment of a Facility PCB Transformer leak until appropriate corrective action was completed, in violation of 40 C.F.R. § 761.30(a)(1)(x); 3. maintaining and making available to EPA for inspection, records of quarterly PCB Transformer inspections and maintenance histories that failed to include required information, in violation of 40 C.F.R. § 761.30(a)(1)(xii); 4. storing two PCB Articles for reuse at an area of the Facility that did not have continuous curbing with a minimum 6 inch high curb for a period in excess of 5 years after the date that each such PCB Article originally was removed from use and without receiving written approval for such longer period of storage, in violation of 40 C.F.R. § 761.35(a); 5. storing three PCB Articles for disposal at an area of the Facility that did not have continuous curbing with a minimum 6 inch high curb for a period in excess of 30 days after the date that each such PCB Article was determined to be PCB Waste and the decision was made to dispose of it, in violation of 40 C.F.R. § 761.65(b); 6. disposing of PCBs at concentrations of 50 ppm in a manner other than in an incinerator that complies with 40 C.F.R. § 761.70, in violation of 40 C.F.R. § 761.60(a); 7. failing to include required information in the Facility’s written annual document logs for each of the calendar years 2002, 2003 and 2004, in violation of requirements of 40 C.F.R. § 761.180(a)(2); and 8. offering PCB Containers and PCB Articles for off-site transport from the Facility with prepared manifests that did not specify the earliest date
