RESPONDENT VIOLATED WVHWMR SUBSECTION 33-20-11.2, WHICH INCORPORATES BY REFENCE 40 CFR SUBSECTION 270.1(b), AND SECTION 3005(a) OF RCRA, 42 U.S.C. SUBSECTION 6925(a) BY OWNING AND OPERATING A HAZARDOUS WASTE STORAGE FACILITY WITHOUT A PERMIT OR INTERIM STATUS. RESPONDENT OFFERED HAZARDOUS WASTE FOR TRANSPORT TO A TRANSPORTER THAT HAD NOT RECEIVED AN EPA INDENTIFICAITON NUMBER. FAILED TO KEEP A COPY OF EACH SIGNED MANIFEST FOR THREE YEARS OR UNTIL THE GENERATOR RECEIVES A SIGNED COPY FROM THE DESIGNATED FACILITY WHICH RECEIVED THE WASTE.
