ORDER TO TERMINATE CONSENT DECREE WITH RESPECT TO THE VICTORIA FACILITY AND TO TERMINATE THE CONSENT DECREE IN ITS ENTIRETY This matter having been raised before this Court on the Unopposed Motion of INV NYLON CHEMICALS AMERICAS, LLC (f.k.a. as INVISTA S.a r.l.) ( INVISTA ) for an Order terminating the Consent Decree entered by this Court on July 29, 2009 and amended December 14, 2011 ( Consent Decree ) as it applies to Case 1:09-cv-00244-CFC Document 29 Filed 01/24/23 Page 2 of 3 PageID #: 1151 INVISTA's Victoria, Texas facility ( Victoria Facility ) and terminating the Consent Decree in its entirety and this Court having considered the Motion and the exhibits annexed thereto, and good cause having been shown, IT IS HEREBY ORDERED this 24day of January, 2023, that the Consent Decree is hereby terminated with respect to the Victoria Facility and in its entirety.
