Case summary

On August 24, 2007, Region III finalized an Administrative Consent Agreement and Final Order against West Virginia Oil Gathering Corporation (“WVOG”) for three violations of Section 311(b)(3) of the Clean Water Act, as amended. WVOG is the owner and operator of a crude oil and transmission pipeline that extends approximately 60 miles through rural West Virginia (the “Pipeline”). Three discharges of oil from the Pipeline occurred into or upon the navigable waters of the United States or adjoining shorelines in harmful quantities, all of which were attributed to internal pipe corrosion by WVOG, as follows: 1) A nine barrel spill on September 26, 2006 into Hollywood Run; 2) A seven barrel spill on January 10, 2007 into an Unnamed Tributary of Henry Fork Creek; and 3) A one barrel spill on March 8, 2007 into Henry Fork Creek. The Administrative Complaint was issued pursuant to Section 311(b)(6)(B)(i) of the Clean Water Act, and proposed a Class I penalty of $5,475.94.
