J.C. BAKER & SONS KNOWINGLY FILLED APPROXIMATELY 0.6 ACRES OF FEDERAL JURISDICTIONAL WETLANDS ADJACENT TO AN UNNAMED TRIBUTARY OF INK RUN. ADDITIONALLY, THE RESPONDENT PLACED AN UNAUTHORIZED CULVERT INTO THE UNNAMED TRIBUTARY OF INK RUN IMPAIRING 20 LINEAR FEET OF STREAM. THE PIPE USED IN THE CULVERT IS UNDERSIZED, AND POSSIBLY IMPROPERLY PLACED WHICH IS CUASING THE NATURAL FLOW OF WATER TO BE RESTRICTED. THE LOCATION OF THE VIOLATION IS IN UPSHUR COUNTY, WEST VIRGINIA.
