Case summary
There was an EPA multimedia inspection of the VAMC. The inspection found violations of RCRA generator requirments and RCRA universal waste requirements. In addition, the inspectors were told that the facility was using No.6 fuel oil in three of its existing boilers even though it did not have a permit for burning such fuel. Moreover, the facility began construction of a new boiler without having received a permit to construct. Finally, the facility also began using No.6 fuel oil for the new boil prior to receiving a permit for its construction. The CAFO entered in this case resolves those allegations. EPA also received from the facility a revised SPCC plan which addressed the CWA concerns of the Agency (EPA can not seek penalties against a federal facility for violations of the CWA).
