Case summary
On June 13, 2006, an authorized represntative of the EPA conducted an inspection of th Better Baked Foods, Inc. facility located at 56 Smedley Street in North EAst, PA, to determine compliance with the Ricsk Management Plan (RMP) regulatlions promulgated at 40C.F.R. part 68 under Section 112(r) of the Clean Air Act(CAA). EPA found that the Respondent had violated regulations implementing Section 112(R) of the CAA. Specifically, the facility failed to: idnetify, evaluate and control the hazards involved in the process based on teh findings from the Process Hazard Analysis; promptly determine and document an appropriate response to each of th findings of the audit and document that deficiencies had been corrected based on the findings form a Compliance audit and; to investigate each incident which resulted in, or could reasonably have resulted ina catastropic release of a regulated substance. On January 23,2007, an Expedited Penalty Action was executed by EPA Region III and filed with the Regional Hearing Clerk for a penalty amount of $900.
