Case summary
On November 16,2006, EPA Region III issued and Administrative Compliance Order to Hershey Creamery Company requiring Hershey Creamery to develop and implement Program 3 Risk Management Programs, in accordance with the Risk Management regulations set forth at 40 C.F.R Part 68, at its facilities at 301 South Cameron Street, in Harrisburg, Pennsylvania, and at 1200 AIP Drive, in Middletown, Pennsylvania. Implementation of a Risk Management Program is intended to prevent the accidental release of hazardous substances and minimize the consequences of the relese of such a substance into the community surronding a facility. Therefore, Hershey Creamery's failure to develop and imlement Risk Management Programs at these the Harrisburg and Middletown facilities places the communities in which they are located at risk.
