Case summary

On December 29, 2006, EPA filed a Consent Agreement and Final Order which was negotiated in settlement of violations of RCRA Subtitle c, 42 U.S.C. subsection 6921-6939e, and the Commonwealth of Pennsylvania's authorized regulations governing hazardous waste management against Avery Dennison Coroporation ( Avery ). EPA and the Commonwealth of fPennsylvania conducted an inspection of Avery Dennison C orporation Performance Polymers Division located in Mill Hall, Pennsylvania on May 25, 2005. These inspections revealed, among other things, that Avery's Performance Polymers Division was operating a TSDF without a permit, failed to document daily inspections of its Hopper Tank, failed to mark cerain equipment, and failed conduct monthly monitoring of its pump and valves. Avery has agreed to pay a penalty in the amount of $77,700 in resolution of all issues.
