Case summary

On August 9, 2019, EPA Region III, the Allegheny County Health Department, and Eastman Chemical Resins, Inc. (Eastman) agreed to a modification of the 2011 CAA Consent Decree involving Eastman's chemical plant in West Elizabeth, PA. The non-material modifications, based on experience in implementing the CD, clarify and streamline certain CD requirements. The original CD was based on allegations that Eastman had on numerous occasions violated the temperature limits on various condensers utilized as air pollution control devices and recordkeeping requirements imposed by various CAA permits and orders.
