Case summary
A referralis being brought by the U.S. Environmental Protection Agency Region III ( EPA ) with the concurrence of the U.S. Army Corps of Engineers, Baltimore District ( CORPS ). In addition, the Maryland Department of the Envrionment (MDE ) has indicated its desire to join the United States as co-plaintiff in this civil enforcement action. This referral seeks initiation of a civil action for injuctive relief and penalties pukrsuant to the Clean Water Act, 33 US.C. sub section 1251, against Janice F. and William Costello, for discarges of polltants to waters of the United States in connection with construction without the appropriate permit puruant to Section 404 of the Clean Water Act 33 U.S.C., subsection 1344, of a stone revetment (a shoreline protection structure) at their property located at 1423 Sharps Point Road in Annapolis Maryland. The same conduct also constitutes violaltion of Section 10 of the Rivers and Harbor Act of 1899, as amended (RHA) 33 U.S.C. subsection 403.
