Case summary

On May 3, 2006 the EPA executed a Consent Agreement and Final Order (CAFO) settling a Notice of Noncompliance and Request to Show Cause issued to the Wilkes-Barre General Hospital (WBGH) for alleged violations of the hospital/infectious waste incinerator (HMIWI) Standards of Performance, 40 C.F.R. Part 60, Subpart Ec ( HMIWI NSPS ), promulgated pursuant to Sections 111 and 129 of the Clean Air Act, 42 U.S.C. sub section 7411 and 7429. The hospital is located at 575 North River Street, Wilkes-Barre, Pennsylvania. Specifically, the CAFO alleges that WBGH failed to establish maximum and minimum operating parameters during an initial performance test, failed to apply for site-specific operating parameters for a unique piece of control equipment, and as a consequence failed to moniotr appropriate operating parameters for the HMIWI; and failed to submit the monitoring information in the required annual reports. WBGH has agreed to pay a $,700 civil penalty to settle this matter.
