Case summary
On April 5, 2006 the EPA executed a Consent Agreement and Final Order (CAFO) settling a Notice of Noncompliance and Request to Show Cause issued to the Thomas Memorial Hospital for alleged violations of the federally enforceable West Virginia hospital/medical/infectious waste incinerator. The CAFO alleges that Thomas Memorial Hospital failed to establish maxium and minimum operating parameters during aninitial performance test, and as a consequence failed to operate its HWIMI in accordance with these operating parameters; and failed to submit the required annual reports for 2002 and 2003. Thomas Memorial has agreed to pay a $5,500 civil penalty to settle this matter.
