Case summary
Respondent, Arsenal Associates, L.P. is a Commonwealth of Pennsylvania Limited Partnership. The Facility is the site of the former Frankford Arsenal which was owned by the U.S. Department of the Army. On July 16 and 17, 2002, the EPA conducted a Compliance Evaluation Inspection of Respondents Facility. The investigation revealed that Respondent owned and had in use or in storage at least eithy three (83) PCB Transformers located at various areas throughout the Facility. On June 30, 2006, a Complaint and Notice of Opportunity for Hearing was filed by REgion III pursuant to the Toxic Substance Control Act. The Complaint alleges violations of the Polychlorinated Biphenyl ( PCB ) Manufacturing, Processing, Distribution in Commerce, and Use Prohibitions. The Regional Judicial Officer signed a Final Ordr on April 12, 2007 regarding the Consent Agreement which had been negotiated in settlement of an Administrative Complaint against Aresenal Associates L.P. issued on June 30, 2006.
