Case summary
On December 28,2005, the Regional judicaial Officer signed a Consent Agreement and Final Order (S SuperCAFO ), which resolved an alledged violation of Setion 103 of CERCLA, 42 U.S.C. subsection 9603, at the Delaware City Power Plant, located at Route 9 and River Road, in Delaware City, Delaware. The violation was asserted in connection with a chlorine release at the facility april 26, 2004. Delaware Operating Services Company ( DOSC ) failed to notify the Natrional Response Center immediately following the release. To settle this matter, DOSC agreed to pay a penalty of $5,000.00
