Case summary
On August 23, 2005, EPA Region III and Timac USA, Inc., of Reading, Pennsylvania, entered into a Consent Agreement and Final Order resolving a violation of Section 7 under the Federal Insecticide, Fungicide and Rodenticide Act. All EPA registered pesticide-producing establishments are required to submit by March 1 of the current year a pesticide production report stating the amount of pesticides produced at the establishment in the past year, and how much the company expects to produce in the upcoming year. Timac USA, Inc. did not send in the report for their facility by the March 1, 2005 due date, thus constituting a violation of FIFRA. As agreed upon in the consent agreement, Timac USA, Inc. has requested the termination of their EPA Establishment Number and will not have to pay a penalty.
