During the course of an EPA inspection in April, 2004, it was found that the facility���s cathodic protection system was not operating for a period of approximately 1 year (i.e., from 12/02 through 11/18/03); the system was then repaired by the defendant on November 18, 2003. The period of non-compliance occurred at the time the facility was owned by the defendant, who was cited for the violation. Ownership by the defendant ended approximately on April 1, 2004, one week prior to the EPA inspection.
