On July 18, 2005, EPA issued a Notice of Determination (���NOD���) pursuant to EPA���s ���Small Business Compliance Policy.��� The NOD is based on self-disclosures provided by PSG Controls, Inc. (���PSG���) for violations of Section 313 of the EPCRA at the facility located at 1225 Tunnel Road, Perkasie, Pennsylvania. PSG disclosed that it had failed to submit Toxic Release Inventory Forms (���Form Rs���) for mercury for the reporting years 2000-2003 and lead for reporting years 2001-2003. The total gravity-based civil penalty for these violations would be $97,612. Since PSG satisfied all of the conditions of EPA���s Small Business Compliance Policy and the amount of economic benefit gained was insignificant, EPA waived the gravity-based civil penalty for the disclosed violations.
