Case summary
Respondent failed to issue annual notification to parents, staff , et. al, and to reinspect buildings used for instruction every three years. Germantown Academy of Fort Washington, PA, signed a Consent Agreement with Region III settling AHERA violations discovered by EPA during a July 7, 2004, inspection. At the time of settlement, Germantown Academy provided documentation demonstrating that the school has taken action to correct the violations and that a total of six thousand sixty dollars ($6,060.00) was spent to bring the school into compliance. Consistent with the AHERA Enforcement Response Policy, Region III factored the amount Germantown Academy spent to correct the violations into the penalty calculation. As a result, the final cash penalty to be paid by Germantown Academy totals $387.00. Approximately, 1, 300 students and 163 staff members have been protected by the corrective measures taken by Germantown Academy. Other violations were cited for which a Notice of Non-Compliance was issued consistent with the AHERA ERP. These violations include the failure to: (1) conduct periodic surveillance (40 C.F.R. �� 763.92(b)(1); (2) assign a designated person (40 C.F.R. �� 763.84(g)(1); (3) maintain records of preventative measures and response actions and; (4) provide maintenance and custodial staff with asbestos awareness training.
