Case summary
On August 23, 2004, the EPA executed a Consent Agreement and Final Order settling a Notice of Noncompliance and Request to Show Cause issued to North Penn Polishing and Plating, Inc. (North Penn) in Sellersville, Pennsylvania. The facility specializes in reconditioning new and used small medical components and fittings and computer chassis parts. Based on EPA���s February 23, 2004 Clean Air Act inspection at the facility and other relevant information, EPA has determined that North Penn failed to comply with certain requirements of 40 C.F.R. Part 63, Subpart T: National Emission Standards for Halogenated Solvent Cleaning (Degreaser NESHAP). More specifically, at the time of the inspection, EPA measured the hoist speed for the open-top vapor degreaser to be 30 feet per minute, while the Degreaser NESHAP requires a hoist speed to be no greater than 11 feet per minute. Other monitoring and recordkeeping violations were noted at the time of the inspection and subsequently incorporated into the NON. North Penn has agreed to pay a penalty of $15,400, plus interest, in instalments over 12 months.
