REMOVAL AO BY CONSENT Under a Consent Order signed by Region III on September 30, 2004, Newell Holdings Delaware, Inc. (f/k/a Anchor Hocking Corporation) has agreed to conduct a removal response action to address elevated levels of lead and PCB contamination in on-Site soils, sediments, and ceramic debris at the 8th and Plutus Streets Pottery Site in Chester, Hancock County, West Virginia . The Site is comprised of approximately eleven (11) acres, most of which is an abandoned pottery manufacturing facility. Respondent (d/b/a Anchor Hocking Corporation) formerly owned and operated the pottery manufacturing facility at the Site. The facility ceased operations in 1982. A June, 2003, removal assessment revealed elevated levels of lead in soils, sediments, and ceramic pottery waste that has been disposed of at the Site. A small area of PCB-contaminated soils at the Site was also discovered during the removal assessment. The Consent Order requires Respondent to: (a) restrict access to the contaminated portions of the Site; (b) conduct an extent of contamination study for lead, PCBs, and additional contaminants associated with pottery manufacturing; (c) excavate and remove all surface soils, sediments, and ceramic debris at the Site that contain concentrations of 400 ppm or greater of lead and 10 ppm or greater of PCBs; (d) arrange for the proper disposal of contaminated surface soils, sediments, and debris; (e) arrange for the proper disposal and/or recycling of glazed ceramic shards; (f) through engineering and institutional controls, contain and prevent the migration of any hazardous substances that will remain in sub-surface soils at the Site after the removal action; and (g) take measures to ensure that residents living at the Site are not exposed to unsafe levels of such hazardous substances at the Site during and after the removal acti
