Case summary

Last March, while conducting joint inspections with PADEP inspectors in Berks County, Pennsylvania, EPA was informed of a problem at Linette's Quality Chocolates in Wolmelsdorf, PA. The PADEP inspectors told us that a large scale septic system was malfunctioning at the Linette facility. Untreated sewage was surfacing on top of the ground around the septic drainfield. Such a system is defined to be an injection well under the Underground Injection Control (UIC) Program. The system was not operating properly and posing an endangerment, a violation of the UIC regulations. Upon inspecting the facility, the UIC Program confirmed that the facility was in violation. Linette's had agreed to cease using its septic system and seek alternative means to deal with its wastewater. To assure that the old septic system was properly closed and that an approvable alternative wastewater disposal system was put into place, EPA issued this Order under the SDWA authority. Presently, Linette's is containerizing its wastewater and having it hauled regularly to a permitted wastewater treatment facility
