On September 15, 2004, EPA Region III entered a Consent Agreement and Final Order (���CA/FO���) with the Commonwealth of Pennsylvania���s Department of General Services (���DGS���) and Department of Public Welfare (���DPW���) (collectively referred to as ���Respondents���), for violations by Respondents of Sections 113 and 502of the Clean Air Act (���CAA���), 42 U.S.C. ���� 7413 and 7661a, 40 C.F.R. �� 52.23, and the Pennsylvania State Implementation Plan (���SIP���), including, but not limited to, 25 Pa. Code ���� 123.11, 123.41. 127.25 and 127.444. DGS owns and DPW operates Torrance State Hospital which is a psychiatric facility providing mental health services located in Torrance, Westmoreland County, Pennsylvania Since at least August 11, 2003, DPW and DGS have been in violation of the CAA, the PA SIP and the federally enforceable Title V Permit at the Facility regarding 3 boilers for both particulate emissions and visible opacity. The parties have agreed to resolve these violations through a cash penalty. DPW has previously agreed to install a replacement boiler to lower emissions at the facility. The Respondents will pay a civil penalty of $28,490 for these violations..
