Case summary
On October 6, 2004, the Regional Judicial Officer signed a Consent Agreement and Final Order ( CAFO ) and Administrative Order on Consent ( AO ) in settlement of an administrative penalty matter in the amount of $16,500 brought against Leo and Patricia Williams and Lycoming Supply ( Respondents ) Monroe County, Williamsport, Pennsylvania for violations of Sections 301 and 404 of the Clean Water Act, 33 U.S.C. ���� 1311 and 1342. In August 2000, Respondents discharged fill material consisting of concrete and brick rubble into wetlands on the Site, removed a beaver dam and sidecasted the material into a tributary to Pocono Creek resulting in the filling of approximately .07 acres of wetlands with secondary impacts to approximately 4 acres of wetlands located on the Site. An ability to pay analysis revealed that Respondents are without sufficient funds to pay the penalty. Respondents have agreed to pay a penalty of $2,500 pursuant to the enclosed CAFO in settlement of this matter, and in addition, pursuant to an AO will remove the rubble and other debris that was deposited in the wetlands on either side of the road.
