Case summary

On September 27 the Director of the Hazardous Site Cleanup Division signed a Unilateral Administrative Order (UAO) pursuant to Section 106 of CERCLA to Vincent Dell���Aversano, owner of the Delaware Sand and Gravel Superfund Site (Site). The UAO requires the respondent to implement institutional controls called for in the July 8, 2003 by an Explanation of Significant Differences for the Site which is located in New Castle County, Delaware. The UAO restricts Respondent���s use of the Site in any manner which would interfere with the protectiveness, integrity and implementation of the remedial action undertaken at the Site. The UAO also requires the respondent to file a title notice with the New Castle County recorder of deeds and submit plans and reports concerning his use of the Site.
