Case summary

On Thursday, September 16, 2004, EPA issued a Notice of Determination (���NOD���) pursuant to the ���Final Policy Statement on Incentives for Self-Policing: Discovery, Disclosure, Correction, and Prevention of Violations���, 65 Fed. Reg. 19618 (April 11, 2000). The NOD is based on self-disclosures provided by Equitrans for violations of Title V of the Clean Air Act. Equitrans failed to submit annual Title V compliance certifications to EPA for three facilities: Hartson-Compressor Station, in Finleyville, PA; Pratt Compressor Station, in Waynesburg, PA; and Rogersville Compressor Station, also in Waynesburg, PA. The total gravity-based civil penalty for CAA violation would be $141,750.00. However, because Equitrans satisfied all of the conditions of EPA���s Self-Disclosure Policy and the amount of economic benefit gained is insignificant, EPA waived the civil penalty for the disclosed violations.
