Case summary

'The Deputy Regional Administrator signed a letter referral to DOJ requesting that DOJ, on behalf of EPA, file a proof of claim with the bankruptcy court against City Wide Service, Inc. (which filed for bankruptcy protection on May 31, 2002) in order to recover past and future response costs already or yet to be incurred by EPA in investigating and remediating the Clearview Landfill Operable Unit of the Lower Darby Creek Area Site. EPA believes that between 1958 and 1976 City Wide Service, Inc. disposed of all of its customers'' waste, including hazardous wastes, at the Clearview Landfill. As of July 23, 2002, EPA has incurred costs of approximately $1.36 million in conducting response actions to address the release of hazardous substances at the Site. EPA estimates that it will incur approximately $1.76 in future remedial investigation and feasibility study costs for the Clearview Landfill operable unit. Furthermore, EPA estimates that the costs of remedial design and remedial action activities at the Clearview Landfill operable unit may exceed $15 million.
