Case summary

On June 30, 2003, the United States Environmental Protection Agency - Region III issued an Administrative Complaint, Compliance Order and Notice of Opportunity for a Hearing ( Complaint ) against Tanks, Pumps & Accessories, Inc ( Respondent ) the owner and/or operator of underground strage tanks ( USTs ) located at 1240 Wayne Avenue, Indiana, Pennsylvania and Route 286, Indiana, Pennsylvania ( Facilities ). The Complaint is filed pursuant to Section 9006 of the Resource Convservation and Recovery Act ( RCRA ), 42 U.S.C. Section 6991e and Section 22.1(a)(4) of the Consolidated Rules of Practice. The Complaint alleges, inter alia, that Respondent failed to provide overfill control on UST tank dispensers, inspect corrosion protection for the UST system's steel piping, and monitor portions of the UST system for relases at least every 30 days at Respondent's Facilities. Respondent has been ordered to remedy the aforementioned violations upon the effective date of the Compliance Order and a total recommended civil penalty has been set at $7,920.00
