On June 30, 2003, the Regional Judicial Officer issued a Final Order pursuant to Sections 22.13(b) and .18(b)(2) and (3) of the Consolidated Rules of Practice Governing the Administrative Assessment of Civil Penalties and the Revocation/Termination or Suspension of Permits ( Consolidated Rules ), 40 C.F.R. section 2213(b) and .18(b)(2) and (3), accepting the Consent Agreement ( CA ) and Settlement Conditions Document ( SCD ) negotiated pursuant to Section 9006 of the Resource Conservation adn Recovery Act ( RCRA ), as amended, 42 U.S.C. section 6991e, to settle violations of RCRA Subtitle I, 42 U.S.C. section 6991-6991i, and the State of Maryland's federally authorized underround storage tank program by Caroll Fuel Independent Co. ( Respondent ) in connection with ts underground storage tanks at Respondent's facilities located at 2725 Sisson Street, Baltimore, Maryland, 12601 Harford Road, Forks, Maryland, and 5900 Jonnycake Road, Baltimore, Maryland (the Facility or Facilities ). Under the terms of the CA, Respondent will pay a civil penalty of $32,728.00 and perform under the SCD a Multi-Facility UST Compliance Audit at approximately 70 facilities owned and/or operated by Respondent in the State of Maryland. Under the SCD, Respondent shall pay stipulated civil penalties for any UST violation discovered pursuant to Multi-Facility UST Compliance Audit
