Case summary

Commencing in or about April 2002, and continuing periodically through June 2002, Respondent, or persons acting on behalf of Respondent, operated equipment which discharged fill material into a stream channel and wetlands on the Site. In order to expand and existing holding pond the Respondent filled approximately 1100 linear feet of stream channel and associated wetlands. At no time during the discharge of pollutants to the waters of the United States did the Respondent, by discharging fill material to the waters of the United States without a permit, has violated Section 301(a) of the Act, 33 U.S.C. Section 1311(a). NO COMPLYING ACTION RECORDED. ALL COMPLYING ACTION CAN BE FOUND UNDER COURT DOCKET NUMBER CWA-03-2004-0027DW.
