Case summary

On March12, 2003, Region 3 signed a CAFO simultaneously commencing and resolving violations by Respondent Eric W. Williams of Section 9003 of RCRA and the authorized WV Underground Storage Tank program regulations. The violations occurred at Respondent's Hess Garage, a former gasoline service station, in South Charleston, WV. The settlement requires Respondent to permanently close four underground storage tanks (with total capacity of 9,500 gal.) by May 31, 2003, including remediation of any leaks that may have occurred. Closure of the USTs, which were never upgraded to protect against spills and leakage in accordance with standards effective December 22, 1998, will also prevent the possibility of their illegal reuse for storage of regulated substances.
