'The bankruptcy referral seeks to have DOJ files proofs of claim against Exide in the United States Bankruptcy Court for the District of Delaware in a matter captioned In re Exide Technologies, Inc. et al., Case Nos. 20-1125, 02-1126, 02-1127 and 02-1128. EPA has identified 20 sites at which it has claims in connection with Exide. Five of these claims involve sites at which Exide is a party to a consent decree and/or order, and EPA seeks to ensure that Exide fulfills its obligations under the consent decree and/or, in the alternative, reimburse EPA for costs it must incur to complete Exide''s obligations and pay the appropriate penalty for failure to comply with the terms of the consent decree and/or order. One of the claims seeks costs recovery for the Hamburg Lead Superfund Site ( Hamburg Lead Site ), where the United States District Court for the Eastern District of Pennsylvania has already held Exide liable, and the only remaining issue is the amount of the costs the United States is entitled to recover. The remaining 14 claims relate to additional lead removal sites that were discovered in and around the Borough of Hamburg Spin-off Sites are all similar to the Hamburg Lead Site, in that they involve contamination from lead battery casings coming from the same Price Battery/General Battery/Exide plant that gave rise to the contamination at the Hamburg Lead Site
