Case summary
On March 26, 2003 the Regional Judicial Officer signed a Final Order on September 27, 2000 regarding the Consent Agreement which has been negotiated in settlement of violations of RCRA Subtitle C, 42 U.S.C. ����6921-6939e, and the Commonwealth of Pennsylvania���s authorized regulations governing hazardous waste management against Philadelphia Rivet, Inc. (facility located in Derry, Pennsylvania). EPA and the Commonwealth of Pennsylvania conducted an inspection of Philadelphia Rivet, Inc.���s rivet manufacturing facility on June 26, 2001. These inspections revealed, among other things, that Philadelphia Rivet, Inc. stored hazardous waste in a tank at its facility without a permit, had an open hazardous waste container, failed to maintain adequate training Records, failed to conduct adequate inspections and failed to maintain an adequate contingency plan. During settlement negotiations, after a review of the financial materials submitted by Philadelphia Rivet, Inc, EPA concluded that Philadelphia Rivet, Inc. was without the ability to pay the originally proposed penalty of $104,432.45. Because of Philadelphia Rivet.���s inability to pay the originally proposed penalty in this matter, the case was settled for a penalty amount of $30, 000 to be paid by way of installment payments.
