Case summary

EPA Region III issued an Administrative order to Thomas J. Fannon & Sons, Inc. (Fannon) of Alexandria, Virginia Alleging that Fannong employed an uncertified technician to maintain, service and repair and air conditioner that contained a regulated refrigerant (R-22), and the employee's actions resulted in the venting of approximately four pounds of R-22 to the atmosphere in violation of the startospheric ozone protection regulations of 40 C.F.R. Part 82, Subpart F, Section 608 of the Clean Air Act, 42 U.S.C. section 7671g. The Order also alleges that the Respondent failed to certify that it had obtained refrigerant reclaiming equipment, also in violation of 40 C.F.R. Part 82, Subpart F. The Order does not propose payment of a penalty but does require the company to quickly come into compliance with the applicable regulation
