The complaint alleges a violation of Section 9006(a) of RCRA, 42 U.S.C. Section 6991e(a). The complaint was filed against the owner, Raymond L. Woodie, trading and/or doing business as Ray L. Woodie, House Moving Contractor Inc ( Respondent ) for a violation associated with the facility formerly known as the Blue Star Gas Station ( the Facility ). Respondent failed to comply with an Order issued June 29, 2001 compelling him to make certain information avalable to EPA upon request pursuant to Section 900t of RCRA, 42 U.S.C. section 6991d. EPA attempted to acquire information from Mr. Woodie regarding possible violations of Subtitle I of the Resource Conservation and Recovery Act ( RCRA ), 42 U.S.C. section 6991-6991i, through the issuance of the two RCRA Section 900t Information Request (April 21, 2000 and July 19, 2000). On June 29, 2001 EPA issued an order compelling him to make the information available to EPA. Although Mr. Woodie and/or his representative received both requests for information and the order he has neglected to answer or respond in any way. This action seeks a penalty for Respondent's failure to comply with the order
