Case summary
On January 29, 2002, the Acting Regional Administrator for EPA Region III signed a Prospective Purchaser Agreement with Longstreth Sporting Goods, Inc. and Parkerford Properties, Inc. relating to their planned acquisition of a property which is part of the Recticon/Allied Steel Superfund Site in Parkerford, Chester County, Pennsylvania ( Site ). Pursuant to the Prospective Purchaser Agreement, Longstreth and Parkerford Properties will pay the EPA $38,000.00 in exchange for a release of the potential liability they might be exposed to under the Comprehensive Environmental Response, Compensation and Liability Act of 1980, as amended ( CERCLA ), 42 U.S.C. Section 9601 et seq., by becoming the current owner and/or operator of a property which is part of a Superfund site. The site was contaminated with various metals and votatile organic compounds ( VOCs ) as a result of historic industrial activities by parties other than Longstreth and Parkerford Properties. Groundwater at the Site is presently being treated to remove VOCs. The Prospective Purchaser Agreement is in the public interest because the local companies' payment will defray EPA's costs of responding to the contamination at the Site and their acquisition of the property will return a portion of the Site to a productive and beneficial use. The Prospective Purchaser Agreement became effective on June 5, 2002 after the closing of a thirty-day public comment period
