Case summary
The Regional Administrator signed a prospective purchaser agreement between the U.S. Environmental Protection Agency ( EPA ), and 950 Rittenhouse, Inc., and 950 Rittenhouse Associates, L.P., in connection with the Commodore Semiconductor Superfund Site. Under the terms of the Agreement, EPA will provide the purchasers with a covenant not to sue, contribution protection and a waiver of any CERCLA lien currently perfected in connection with the property pursuant to Section 107(l) of CERCLA, 42 U.S.C. section 9607(l). In exchange, the purchasers will pay $5,000.00 that will be applied towards the United States' unreimbursed past response costs incurred in connection with the Site. The purchasers also agree to continue to comply with existing access agreements and easements previously entered into with the prior Site owners, GMT Microelectronics Corporation and Rockwell Automation, Inc. The purchasers have also agreed to comply with the institutional controls identified in EPA's September 29, 1992, Record of Decision and the Explanation of Significant Differences issued by EPA on May 5, 1993. Specifically, the purchasers are prohibited from drilling, installing, using, or permitting the use of any new groundwater wells in areas of groundwater contamination on the Property where rthe contaminants of concern exceed their respective maximum contaminant levels established by EPA pursuant to the Safe Drinking Water Act, 42 U.S.C. section 300f to 300j-2
